Writ petition seeking change in criteria for appointment of judges

KATHMANDU: A writ petition has been filed in the Supreme Court seeking revocation of the new criteria for appointment of judges brought by the Judicial Council of the Supreme Court.

Advocates Kritinath Sharma Poudel and Tulsiram Pakhrel have filed a petition demanding Badar’s resignation. The new criteria stipulates that for the appointment of a judge in a high court, a lawyer has to debate 50 cases.

Advocate Poudel said that it was against the constitution. Earlier, a person who worked as a lawyer for 10 years was eligible to become a high court judge.

The Judicial Council of the Supreme Court had brought the criteria on January 27. The petition seeks to repeal the provision.

The petition includes the chairperson of the Judicial Council, the Minister of Law, senior judges of the Supreme Court, members of the Nepal Bar Association and members of the Judicial Council appointed by the President. The case is set to be heard on Sunday.
